DUI General Information

According to California Law, it is illegal to operate a motor vehicle while under the influence of alcohol or drugs.  You can be charged with a DUI (driving under the influence) under two separate laws:

• California Vehicle Code 23152 (a) stipulates that it is unlawful for any person who is under the influence of any alcoholic beverage or drugs, or under the combined influence of any alcoholic beverage and drugs, to drive a vehicle.
• California Vehicle Code 23152 (b) stipulates it is unlawful for any person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.

For purposes of this article and Section 34501.16, percent, by weight, of alcohol in a person's blood is based upon grams of alcohol per 100 milliliters of blood or grams of alcohol per 210 liters of breath.
Please note that if you are under 21 years old, you will be charged with a DUI if your alcohol level is .01% or above.  Even if your Blood Alcohol Level (BAC) is below the legal limit of .08, and you are over 21 years old, you can still be charged with a DUI if your ability to drive is impaired.
