DUI Blood Alcohol Testing

Sacramento DUI Attorneys at Amaya & Associates work aggressively and with precise detail to determine if blood-alcohol tests were performed and completed in a reliable manner by police officers.  According to California DUI Law you can be charged with a DUI if you have a blood alcohol concentration (BAC) of .08% or above.  Blood alcohol content or blood alcohol concentration is the number of grams of alcohol (ethanol) present per 100 milliters of blood in a persons system.

DUI Breath Test Machine

There are a number of DUI Testing Machines such as the Intoxilyzer 8000, BAC Datamaster, Intox EC/IR, etc.  Each of these DUI breath test machines attempts to measure the concentration of alcohol in the deep lung region called the "alveoli."  These devises use one or two technologies to meaure BAC, (1) electrochemical oxidation and infrared spectroscopy.  The reality is that these testing methods have significant flaws and problems.  In many cases this can lead to wrongful prosection and conviction.

An experinced Sacramento DUI defense attorney can challenge the reliability of the devises. Title XVII of the California Code of Regulation requires that records be maintained by local law enforcement agencies on breath test machines. As skilled DUI lawyers we closely review the records maintained by law enforcement showing the calibration and accuracy of these intruments. It is also important to note that these tests can have differenct readings for different individuals depending on the person's weight, body metabolism, gender, type of alcohol, ammount of breath blown into the breathalyzer and alcohol absorption.

Blood Alcohol Tests

Just as breath test machines, a blood-test  measures the concentration of alcohol in a person’s blood.   If the police office suspects that the individual is driving under the influce, the person will be generally transported to a medical fasciltiy where blood will be drawn and later tested by a police labratory to determine alcohol concentration.

It is essential that you hire a Sacramento DUI attorney that can challenge these tests results on different levels and factors.  It is  important to determine if the blood was drawn by a licensed individual.  Blood must be collected in a way that it is not contaminated and it must be properly stored.  Was there sufficient preservative used to prevent further fermentation of alcohol in the blood sample?  Was the blood properly transported between laboratories. Were the results accurately read by the machine.

These and other factors must taken into consideration by a skilled dui attorney when devising a client's defense.  Our DUI attorneys will advocate for your rights, thoroughly invetigate the conditions of your arrest and fight to keep your driving priveleges.
